The session will last approximately 90 minutes, starting with a full presentation in which we will explain the main regulations of the Data Protection Bill 2021, followed by a question-and-answer session where all members can ask questions and / or discuss issues.

Here’s what we’ll cover:

  • Obligations of the Data Trustees: Data trustees will have to complete a list of obligations and respect the limitations regarding the processing of personal data, under penalty of penalties. What are the obligations and how will they be penalized?
  • Age of consent for children’s data: Data trustees can only process children’s data with the consent of guardians. What other conditions must data trustees meet?
  • Role of the data protection officer: Data trustees will need to hire data protection officers, who will be responsible for ensuring compliance with the bill. What are the responsibilities of the DPD?
  • Data localization and cross-border transfers: All sensitive personal data should be stored in India and can only be transferred outside under specific circumstances. What are these circumstances?
  • Powers of the Data Protection Authority: A Data Protection Authority (DPA) will investigate data breaches and ensure compliance with the provisions of the bill. What are the powers of the DPA?
  • Protocol to follow in the event of a data breach: When data breaches occur, data trustees must notify the DPA within 72 hours of discovery. What other protocols does the bill establish regarding data breaches?
